ok so there is a warranty thing for the ipod nano but does this mean that if i send mine in i might get charged 100$ plz read

Apple may charge you a diagnostic fee, including shipping charges, of no more than one hundred ($100) dollars US, plus applicable tax, if Apple inspects your product and determines based on the inspection that the product does not require service. 1. An estimate for repairs, as required (section 9844 of the California Business and Professions Code), shall be given to the customer by the service dealer in writing. The service dealer may not charge for work done or parts supplied in excess of the estimate without the prior consent of the customer. Where provided in writing the service dealer may charge a reasonable fee for services provided in determining the nature of the malfunction in preparation of a written estimate for repair. 2. A buyer of this product in California has the right to have this product serviced and repaired during the warranty period. The warranty period will be extended for the number of whole days that the product has been out of the buyer's hands for warranty repairs. The warranty period also will be extended if the warranty repairs have not been performed due to delays caused by circumstances beyond the control of the buyer, or if the warranty repairs did not remedy the defect and the buyer notifies the manufacturer or seller of the failure of the repairs within 60 days after they were completed. If, after a reasonable number of attempts, the defect has not been fixed, the buyer may return this product for a replacement or a refund subject, in either case, to deduction of a reasonable charge for usage. I just talked to Apple. They said the bottom half of the email does not apply as it is a recall. They will not charge and will replace the ipod with the exact same product. They also said they were overwhelmed with responses and way behind on mailing out the package to mail in the ipod.

1st generation ipod nano's are being recalled by Apple because of a defect they determined in the battery. Apple has agreed to replace them free of charge to customers who are experiencing this problem. They will test it and if the problem is indeed with the battery, it will be replaced to you at no charge. The $100 charge is meant to warn people out there that are looking to take advantage of this recall...if you send them an ipod nano knowing very well it does not have a problem with the battery and are just looking for an upgrade, they may slap you with the $100 charge for wasting their time. My nano does not hold a charge for more than a few hours without going dead and it's a darn shame. I am glad they are doing good on their part by offering a replacement. I have spend thousands of dollars with Apple in the past few years.

If your Nano is truly a 1st gen, then it's WAY out of warranty and you'll be charged for any repair. Frankly, you'd do better to buy another new or used Nano at this point.
